Judgment in Real Estate Investment Dispute over Breached Settlement Agreements

Ahmed Dharsi LLP secured a significant judgment on behalf of clients in a complex enforcement proceeding involving breached settlement agreements related to a residential real estate development.

Our clients had either invested in or loaned substantial sums to a development company. When the project faltered, the parties negotiated structured buyouts and debt repayments. After the opposing parties defaulted on their obligations, we brought an application to enforce the settlement terms. The court granted full judgment against the respondents, totaling over $880,000 including penalties for delay and prejudgment interest. We also obtained a cost award in our clients’ favour.

The case involved allegations of duress, improper execution, and attempted avoidance of personal liability, all of which were dismissed in full.

Significance

This case demonstrates how clearly drafted settlement agreements, when paired with assertive litigation strategy, can be powerfully enforced, even in highly contested, multi-party commercial disputes.
